Welcome to CommunalResourcePark ("we," "our," or "us"). These Terms & Conditions ("Terms") dictate your engagement with our yacht charter services and the website situated at communalresourcepark.site (the "Service"), provided by CommunalResourcePark.
Upon booking a charter or utilizing our Service, you consent to adhere to these Terms. Should you object to any part of these terms, you are not permitted to use the Service.
2. Service Overview
CommunalResourcePark offers luxury yacht charter services, which include, but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Special events
- Long-duration charters
Service availability is contingent on weather conditions. We reserve the prerogative to alter or terminate services at our sole discretion.
3. Booking and Reservations
3.1 Booking Process
Charter reservation prerequisites are as follows:
- A minimum age of 18 years
- Provision of accurate, comprehensive information
- A paid deposit as indicated in the booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed solely after payment is made and you receive our explicit written confirmation. We hold the right to reject service to any individual at our preference.
3.3 Availability
Chartering is dependent on yacht availability and appropriate weather. We aim to accommodate your desired dates and timings as far as possible.
4. Payment Terms
4.1 Pricing
All pricing is articulated in € and encompasses relevant taxes unless stated otherwise. Pricing policy is subject to changes without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total cost of the charter is due upon reservation
- Balance: Must be paid 48 hours before the departure of the charter
- Additional fees (if any): To be settled after the charter completion
4.3 Payment Methods
Accepted methods of payment include major credit cards, wire transfers, and certified bank drafts. We employ encrypted processing systems for payment procedures.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Full refund minus processing fees if canceled more than 72 hours prior to departure
- A 50% refund for cancellations made between 24 to 72 hours before departure
- No refund if canceled less than 24 hours before departure
5.2 Weather Cancellations
If the captain deems weather conditions as unsafe, we offer to:
- Postpone your charter to an available date without extra cost
- Provide a complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
In case of mechanical failure of the designated vessel, we will strive to provide an appropriate alternative. If no such alternative can be arranged, a full refund will be given.
6. Safety and Conduct
6.1 Safety Requirements
All voyagers are mandated to:
- Obey all directions from the crew
- Use the safety gear as needed
- Disclose any medical conditions that might impinge on their safety
- Stay within permitted areas on the boat
6.2 Prohibited Items
The following articles are forbidden on the vessel:
- Glass materials
- Unlawful materials
- Weapons or guns
- Excess amounts of beverages (exceeding permitted consumption)
- Animals (unless prior authorization is obtained)
6.3 Conduct
Travelers are expected to exhibit composure and respectfulness. A voyage may be ended prematurely without a refund if passenger actions pose a danger or disrupt the experience for others.
7. Liability and Insurance
7.1 Our Liability
Our accountability is restricted to the charter fee paid. We will not be deemed responsible for:
- Personal injury arising from passenger carelessness
- Loss or impairment of private belongings
- Indirect, consequential, or exemplary damages
- Delays occasioned by inclement weather or events beyond our governance
7.2 Insurance Coverage
Comprehensive marine insurance is maintained to cover our vessels and operations. Passengers should have their personal travel and property insurance.
7.3 Assumption of Risk
Engaging in our charter services implies acknowledgment of maritime activities' inherent dangers, and you assume personal liability for your safety and well-being.
8. Modifications and Itinerary Changes
We reserve the prerogative to adjust itineraries, routes, or schedules due to weather, safety, or operational needs. Efforts shall be exerted to ensure a similar alternative experience is provided.
9. Force Majeure
Our liability does not extend to any delays, cancellations, or alterations steming from events outside our influence, inclusive of, but not limited to:
- Harsh weather conditions
- Catastrophes
- Legal enactments
- Harbor closures
- Technical malfunctions
10. Privacy and Data Protection
Your personal data is treated in compliance with our Privacy Policy. Utilizing our services signifies consent to the accumulation and application of your data as detailed in our Privacy Policy.
11. Intellectual Property
All materials on our website, such as texts, visuals, trademarks, and images, are safeguarded by copyright and trademark legislation. Unauthorized replication, distribution, or creation of derivative works is prohibited without our express written authorization.
12. Governing Law
The jurisdiction of Spain's laws applies to these Terms. Disputes shall be resolved within the courts of Barcelona, Spain.
